20 ANOS DA LEI N° 9.433/97: PERCEPÇÕES DOS COMITÊS DE BACIA HIDROGRÁFICA E DOS ÓRGÃOS GESTORES ACERCA DA IMPLEMENTAÇÃO DA POLÍTICA NACIONAL DE RECURSOS HÍDRICOS

Resumo

O presente artigo objetivou avaliar a percepção dos Comitês de Bacia Hidrográfica e dos órgãos gestores de recursos hídricos, dois importantes integrantes do Sistema Nacional de Gerenciamento de Recursos Hídricos, quanto à implementação dos instrumentos de gestão estabelecidos na Lei nº 9.433/97, 20 anos após a sua promulgação. Constatou-se que a maioria dos órgãos gestores está focada em operacionalizar a outorga e em elaborar os Planos de Recursos Hídricos. Já dentre os Comitês, a maioria ainda está investindo na elaboração e implementação dos Planos de Bacia, com recursos financeiros oriundos, em parte, dos estados, e em operacionalizar a cobrança. O estudo destaca a importância do entendimento dos aspectos regionais e da regulamentação das legislações. Os autores concluem pela necessidade da criação de fundos e mecanismos de apoio técnico e financeiro às atividades dos Comitês, principalmente em regiões onde a sustentabilidade financeira através da cobrança não é viável.

Abstract

The objective of this study was to evaluate the perception of the Hydrographic Basin Committees and the water resources management organs, two important members of the Water Resources Management System, as well as the implementation of the management tools established in the National Water Resources Policy, 20 years after its promulgation. It was verified that most of the water resource management bodies are focused on the operationalization of the granting of water resources and on drawing up the Water Resources Plans with the Hydrographic Basin Committees. Among the Committees, most are still investing in the elaboration and implementation of the Basin Plan, mostly financed in part by the state, and in operating the charge for water uses. It is needed a better understanding of regional aspects and regulating existing legislation. A set of actions should also be carried out in order to create funds and mechanisms for technical and financial support for the activities of the Committees, especially in regions where financial sustainability through charging for the use of water resources is not possible.
